As a consumer, you have rights. Understanding these rights are imperative in the credit restoration process- especially when dealing with debt collectors. Some of the less discussed rights you have are:

1) Debt collectors (with the exclusion of attorneys) are not allowed to charge interest or fees on a debt unless it was conditioned in the terms and agreement of your original loan

2) You have the right to dispute with the original creditor- regardless of the current collector

3) You have the right to ask for proof of obligation, primarily in the first 30 days of being contacted by a collector

4) Upon written request, debt collectors are not allowed to ignore your instruction to not call you regarding a debt

5) Once a debt reaches a certain age, it can no longer be taken to court. This age requirement is state and debt-type specific.

Your rights can be found in various laws spelled out in the Fair Credit Reporting Act and the Fair Debt Collections Practices Act. We encourage you to familiarize yourself with these laws.
