If you have Medicare or Medicaid, you may not be responsible for remainder bills for hospital stays. Further, if you visit a hospital that is in your network, but receive services from an out-of-network physician, the overage that the out-of-network physician charges you may be limited to the cost that would be assessed by an in-network physician. With the passing of bill HB 221 in 2016, coupled with the fact that balance billing is already barred with HMOs, Floridians are better protected against this unfair billing practice. If these accounts are sold to debt collectors there are Fair Debt Collection Practices Act (FDCPA) violations that could be at play.

Many people have had issues with out-of-network anesthesiology and radiology service providers that bill separately than the ER.
